Apple seeks $73.4 million from Epic Games in legal fees.

Introduction: The legal saga between tech giant Apple and gaming powerhouse Epic Games continues to unfold, with Apple now pursuing a hefty legal bill of $73.4 million from Epic Games. This development comes after Apple emerged victorious in the antitrust case brought against it by Epic Games.


Background: The dispute traces back to August 13, 2020, when Epic Games introduced a direct payment option in the Fortnite app for iPhone and iPad, bypassing Apple's in-app purchase mechanism. In response, Apple removed Fortnite from the App Store, citing policy violations, and subsequently shut down Epic Games' developer account. This prompted Epic Games to file a lawsuit against Apple in the U.S. District Court for the Northern District of California.


Legal Proceedings: The legal battle unfolded over several months, with Apple filing a countersuit accusing Epic Games of breach of contract, theft, and seeking additional monetary damages. In September 2021, U.S. District Judge Yvonne Gonzalez Rogers ruled in favor of Apple on most counts, finding its anti-steering conduct anti-competitive but not declaring Apple a monopolist.


Financial Implications: As part of the judgment, Epic Games was ordered to pay damages amounting to 30% of the revenue collected through the direct payment option in Fortnite between August 2020 and October 2020, plus 30% of any subsequent revenue until the date of judgment, along with interest.


Apple's Legal Bill: Now, with the Supreme Court declining to hear the appeal from either party, Apple is seeking reimbursement for its legal expenses. The tech giant has presented Epic Games with a staggering bill of $73,404,326, attributing the damages to Epic's breach of the developer agreement during the course of the legal proceedings.


Negotiations and Final Figures: Interestingly, Apple initially claimed to have spent $82,971,401 on the case but later adjusted the amount to $81,560,362. Apple granted Epic Games a 10% discount due to the loss of one of the nine counts, resulting in the final bill of $73,404,326.
