Not so intelligent AI? Air Canada forced to honor false refund policy in landmark ruling.

Air Canada has been compelled to honor a fictitious refund policy generated by its AI chatbot, following a ruling in a civil court that could set a significant precedent. The case involves a customer who received incorrect information about refunds from the AI chatbot on the airline's website and sought to claim a refund based on the misleading guidance. This landmark decision challenges the notion that chatbots operate as separate legal entities and holds companies accountable for the actions of their AI systems.


The Incident: Jake Moffat, the petitioner, sought information about Air Canada's bereavement rates after his grandmother's death through the AI chatbot on the airline's website. The chatbot provided misleading instructions, prompting him to book a flight immediately and request a refund within 90 days. Contrary to the actual policy, Moffat followed these instructions, took the flight, and later sought a refund, which Air Canada initially refused.
