X Social Media Accuses Elon Musk's X Corp of Trademark Infringement and Unfair Competition.

In a legal development that was perhaps inevitable, X Social Media LLC, an advertising agency based in Florida, has initiated a federal court lawsuit against Elon Musk's X Corp over the rebranding of Twitter. X Social Media (hereafter referred to as XSM for brevity) alleges that X Corp has violated Florida common law through acts of "unfair competition and trademark and service mark infringement," along with infringing upon the state's Deceptive and Unfair Trade Practices Act.


The heart of XSM's grievance, as stated in the complaint, revolves around its registered trademark, "X SOCIALMEDIA," which the agency has been consistently using since 2016. According to XSM, the company has already incurred a decline in revenue that can be directly attributed to X Corp's rebranding and use of the mark "X."

The strength of X Social Media's legal case remains uncertain, as it confronts the intricate terrain of trademark disputes, particularly in a domain where numerous entities employ the "X" branding. Law professor Alexandra Roberts, in an earlier statement to The Verge, acknowledged the challenge posed by the abundance of "X" trademarks, which may complicate individual claims by X-branded services, be it Musk's X Corp or entities like X Social Media.
